New offenses include:

Enticement of a Child by Electronic Communication:
Enticing a child to engage in prostitution, human trafficking, or commercial sexual activity by means of electronic communication is punishable by a fine of not less than $2500 and/or up to 2.5 years in jail or 5 years in prison.

Human Trafficking for Sexual Servitude:
It is a crime to knowingly subject, recruit, entice, harbor, transport, provide or obtain by any means or attempt to do any of the same or to cause another person to engage in the following:

  1. commercial sexual activity
  2. a sexually-explicit performance
  3. the production of unlawful pornography

If the person so trafficked is a child, the crime is punishable by up to life imprisonment with a minimum mandatory sentence of 5 years in state prison.

Human Trafficking for Forced Services:
It is a crime to knowingly subject another person to forced services or to recruit, entice, harbor, transport, provide or obtain by any means or attempt to do any of the same, another person, intending or knowing that such person will be subjected to forced services.

If the person so trafficked is a child, the crime is punishable by up to life imprisonment with a minimum mandatory sentence of 5 years in state prison.

Enhanced Penalties & Amendments to Existing Crimes:

Soliciting a Prostitute:
Soliciting or receiving compensation for soliciting a prostitute is a crime punishable by up to 2.5 years in jail and/or a fine between $1000-5000.

Sexual Conduct for a Fee:
Engaging, agreeing to engage, or offering to engage in sexual conduct with another person in return for a fee is a crime punishable by up to 1 year in jail and/or a fine up to $500.

Paying, agreeing to pay or offering to pay any person to engage in sexual conduct, or to agree to engage in sexual conduct with another person is a crime punishable by up to 2.5 years in jail and/or a fine between $1000-5000.

Paying, agreeing to pay or offering to pay any person to engage in sexual conduct with a child under the age of 18, or being paid, agreeing to pay or agreeing that a third person will be paid in return for aiding a person who intends to engage in sexual conduct with a child under the age of 18 – whether such sexual conduct occurs or not – is a crime punishable by up to 10 years in prison or 2.5 years in jail and/or a fine between $3000-10,000.
